We respect and value the privacy of the people we deal with and are committed to protecting your privacy and complying with the Privacy Act 1988 (Cth) (Privacy Act) and other applicable privacy laws and regulations.

The Act allows personal information to be collected, used, and disclosed for the purposes for which it was collected in accordance with the Act.

McCann Properties also has its own privacy policy which details our policy in connection with our real estate agency business and describes how we collect, hold, use and disclose your personal information, and how we maintain the quality and security of your personal information.

This Privacy Policy may be revised, updated or replaced from time to time, and we may subsequently notify users of any changes to it by posting the revised, updated or replaced Privacy Policy on our website.  Any changes to it take effect on the date on which the revised, updated or replaced Privacy Policy is posted to our website.

Personal information we collect

 “Personal information” In general terms, includes information or an opinion that personally identifies you either directly (e.g. your name) or indirectly. What personal information do we collect? The personal information we collect about you depends on the nature of your dealings with us or what you choose to share with us. The personal information we collect about you may include: name; mailing or street address; date of birth; email address; phone number; bank details.

Why we collect the information

We use personal information for many purposes in connection with our functions and activities, including the following purposes: provide you with information or services that you request from us; improve the quality of the services we offer; internal administrative purposes; marketing and research purposes.

How we collect the information

We collect your personal information directly from you: by interacting with us over the phone; interact with us in person; interact with us online; subscribe to our mailing list; apply for a position with us as an employee or contractor or apply for a rental property.

Retention of personal information

We will not keep your personal information for longer than we need to. In most cases, this means that we will only retain your personal information for the duration of your relationship with us unless we are required to retain your personal information to comply with applicable laws, for example record-keeping obligations.

McCann Properties will take reasonable steps to ensure that the personal information that we hold about you is kept confidential and secure and protected from misuse, loss or unauthorized access, modification or disclosure. We do this by:

  • having a robust physical security of our premises and databases / records
  • taking measures to restrict access to only personnel who need that personal information to effectively provide services to you
  • having technological measures in place (for example, anti-virus software, fire walls).

We may store information about you in cloud or other types of networked or electronic storage.  As electronic or networked storage can be accessed from various countries through an internet connection it is not always practical to know in which country personal information about you may be held. 

Where appropriate, we use secure transmission facilities.  However, no transmission of information over the internet can be guaranteed to be completely secure and we do not warrant the security of any information transmitted to us over the internet.

Information disclosed

We will use and disclose personal information only for the purposes for which it is collected in accordance with the Act, including:

  • providing services and customer support, including service updates
  • maintaining and updating our records
  • comparing information for accuracy, and verifying it with third parties; and
  • providing information as authorised or required by law or a relevant government body or authority.

Overseas disclosure

We do not disclose personal information overseas.

We may use cloud storage and IT servers that may be located overseas to store the personal information we hold.  As electronic or networked storage can be accessed from various countries through an internet connection it is not always practical to know in which country information about an individual may be held.

Anonymity and pseudonyms

General users of the website do not need to disclose their identity to us in order to use this website. This website does not, therefore, collect personal information about people who generally access it except in the circumstances described above.

Please note that we may not be able to provide you with some or all of our services if you are anonymous or use a pseudonym.

Marketing and opt-out

We may use the information, including personal information (excluding sensitive information), provided by our clients for marketing purposes, for example to inform users of properties we have available for sale or rent, competitions run by us, a charity campaign we support or other information which we consider may be of value or interest to you, unless you tell us, or have previously told us not to. We will not use your sensitive information for these purposes without your consent.

Accessing your personal Information

Clients or users of our website whose information we either collect, use, or disclose have the right to request access to any personal information held by us which relates to them, unless we are permitted to withhold that information. Any requests for access to a user’s personal information should be made in writing to the Privacy Officer (details specified below).  The user also has the right to request the correction of any personal information which relates to them that is inaccurate, incomplete, irrelevant, misleading, or out-of-date.
